Summary

The Republic of Estonia became a Member State of the Council of Europe on 14 May 1993. At the same time Estonia also signed the European Convention on Human Rights which will be ratified in the nearest future. In connection with this, several new problems arise as residents of Estonia may, for the protection of their rights, have recourse to the Estonian courts as well as to the European institutions protecting human rights. The author notes that the largest number of complaints concern Articles 5 and 6 of the European Convention on Human Rights. Article 5 provides for everyone's right to liberty and security of person, and Article 6 provides for the rights and guarantees pertaining to court procedure. The author brings examples of cases settled in the European Court of Human Rights in Strasbourg.
