Summary

Disputes about the relationship of politics and law rise and fall. Even in the tense situation of fighting a pandemic, the principles of a functioning state become actual. This, especially, in the light of an approaching important date for our constitutionalism. Critical allegations about the insufficient adherence to the principle of separation of powers are not infrequent, especially those made by the legislative authority. The supposed infringers – the executive branch and the judiciary – have modestly tried to rebuke these claims. Ignoring emotions, it can be said in advance that both sides are right. The author provides a short glimpse into the current complexities of exercising political power in the structure of our statehood. The article primarily covers the problems of delegating law-making and the intrusion of judicial decisions into politics.
