Summary

This article discusses the issues related to entry into contracts for financing medical treatment. Entry into contracts for financing medical treatment is closely related to everyone’s right to the protection of their health and the obligation of the state to organise health care services. The entry into contracts for financing medical treatment has, in practice, brought about several legal disputes focusing on the violation of various fundamental rights, such as freedom of enterprise, equal treatment, etc.

The article analyses issues that the author considers important with regard to entry into contracts for financing medical treatment, such as insufficient transparency of decision-making in financing treatment, criteria for assessing the quality of the health care service provided or bought, maintaining the required quality, limiting the freedom of enterprise concerning contracts for financing medical treatment as well as trends in provision of health care services on the free market and full competition in the European Union.
