Summary

In this article, the author explores the legal issues related to the scope of the right of representation of organisations of collective representation in Estonia. The article analyses practical problems that have emerged in connection with the exercise of copyrights by organisations of collective representation. The focus is on the extended model of collectively exercising copyrights which has been successfully used in the Nordic countries for years. Currently, the extended model of collectively exercising copyrights applies in Estonia only to the exercise of the right to transmit via the satellite. The article seeks an answer to the question whether it is necessary and possible to use the extended model of collectively exercising copyrights in other areas too. In addition, the article addresses the right of representation of organisations of collective representation in the case of obvious violation of the holders of copyrights.
