Summary

The intervention of the state in economy must be as intense as required but as minimal as possible. Although Estonia tries to appear as a perfect example of business freedom and free market, the author considers the intervention by the state to be unprecedentedly extensive. The article discusses problems like the absence of the private prosecution institute, paternalism and statism; the regulation of surveillance that is in conflict with the European Convention on Human Rights (ECHR) along with lack of right of defence which forces economic operators into dire straits; widespread application of the method of economic interpretation and violation of Article 8 of ECHR and §26 of the Constitution by forced publication of income and economic indicators.
