Summary

The present institutional system of the European Union can be looked at as an organisation having certain constitutional features, and the effective treaties of the European Union can be regarded as partially formulated constitutional law. At the same time, the constitutional organisation of the European Union is based on neither a single nor a composite constitution. The author analyses whether Europeans need a differently constructed and functioning constitutional organisation and whether the present or future constitutional organisation of Europe should be based on a single constitution as a legal basis and source. As the requirements for the constitutional organisation of the European Union cannot be separated from the question about the future development of the Union, the author proposes several development options. Also, the author examines the possible properties and functions of European constitutional law. Finally, the author puts forward a catalogue of the legal requirements for the constitutional organisation of the European Union, which, in the author's opinion, could function as a philosophical meta-requirement for legal and social-political activities constituting the subject matter of constitutional law.
