Summary

Pursuant to the Criminal Procedure Code, forensic psychiatric examination is obligatory in order to determine the state of mind of a person charged or accused, a suspect, victim or witness if the investigator, examining judge, prosecutor or court has doubts regarding his or her state of mind. The basis for examination established in the Code is often misconstrued, and no attention is paid to the circumstances under which there is sufficient ground for the rise of such doubts. The author analyses in depth the preparation and application of forensic psychiatric examination.
