Summary


This is a follow-up to an earlier article by the author which dealt with the status of the employer in Estonian labour law. This article dwells upon issues relating to the determination of the scope of application of Employment Contracts Act and the definition of employee and employment contract. Employment Contracts Act is the most significant legislation in the regulation of individual employment relationships. The determination of the scope of application of Employment Contracts Act also allows to specify the scope of application of labour law. Pursuant to § 5 of Employment Contracts Act, this Act extends to all employees and employers who conclude an employment contract. This section provides three key words for the determination of the scope of Employment Contracts Act: employee, employer and employment contract.
