Summary

In order to adjudge of the return of or compensation for illegally alienated property one often has to have good konowledge in the theory and history of law. Sometimes it is extremely difficult to clear up who was the owner of the property before its expropriation.

The author of the article offers a survey of a recent case where the present owner of buildings court. Namely, the buildings had been erected on reneted land and their return was claimed by the landholder while according to the Baltic Private Law a landholder cannot be the owner of the buildings located on rented land.
