Summary

The author of the article is no specialist in medical law. He has been inducted to write the article by literature, actual situation and judicial practice. It has been supposed that criminalistics „woke“ medical law while its primary institutional apperance was forensic medicine. During the latest three decades the theory of medical law has been actively dealt with in all developed countries. At the present time the most topical problems of medical law are, undoubtedly, connected with the transplantation of organs. In relation to problems of transplantation all countries can be divided into three groups: 1) those regulating this field by special laws; 2) countries regulating general principles of transplantation at the level of law; and 3) those where the problems have not been regulated legally or are regulated at the level of administrative acts. The Republic of Estonia belonges to the third group. Consequently, a lawyer specializing in medical law in Estonia need not be afraid of unemployment.
