The article deals with the content and treatment of judge-made law (a phenomenon very closely connected with case law) in German legal literature. It explains how judge-made law has developed from the difficulties in herent in law interpretation theories. The article points out the differences of continental judge-made law and Anglo-American case law in the corresponding legal systems.
