Summary

The current Police Act is neither clear enough nor specific enough for us to speak of the restriction of fundamental rights pursuant to law. For this reason the Ministry of Justice together with German experts began to draft a new Law Enforcement Act in 1997. This article reveals the preliminary concept behind the Law Enforcement Actand explains why this concept was abandoned before completion of the text in the Ministry. The Ministry of Justice is nevertheless committed to reforming this area of law, and the draft Law of Enforcement Act remains in the work plan of both the Ministry and the Government. To date, the preliminary structure and wording of the law are in place. The author explains why enactment of the Law Enforcement Act is important, and provides an overview of the principles and policy choices incorporated in the current draft.
