Summary


One of the main objectives of the European Union – the free movement of persons – also involves the free movement of labour. The freedom of movement of labour means the right to freely move, stay and settle after employment in the territory of another country. On the one hand, the freedom of movement of workers must secure the creation of a balanced labour market and a high level of social security of the citizens of the European Union, and on the other hand, enable worker to improve their living and working conditions.
The article introduces the corresponding EC legislation and court practice. The author analyses the definitions of worker, public servant and family member of a worker. Also, the author states that the freedom of movement of workers may be restricted tp protect public order, security and health.
In the nearest future, Estonia will also have to apply measures to guarantee the freedom of movement. Co-ordination of the social insurance system with the corresponding EU systems may pose a problem since social benefits in Estonia do not comply with the corresponding European standards.
