Summary


This article briefly addresses changes in the procedure before the Supreme Court that were brought about by the passage of the new Code of Civil Procedure. An important amendment introduced by the new Code is the requirement to obtain leave to proceed a matter before the Supreme Court. The grant of such leave is decided on the basis of an appeal. Leave is granted if a circuit court has erred in the application of the rules of substantive law or materially breached the rules of procedure.
In addition, in view of the need to establish a uniform court practice, the new Code includes an important provision under which leave to proceed a matter by the Supreme Court is granted if a judgment by the Supreme Court is necessary for the uniform application of law.
