Summary


The article provides an overview of the nature of building leases in the Republic of Estonia, focusing on their specific characteristics in contrast to other restricted real rights. The author analyses differences between the corresponding Estonian and German Acts. Further, the author dwells upon some errors made in practice upon entry into contracts for the establishment of building leases and points out gaps in the existing legislation. The author also deals with possible types of agreement which should be stipulated in real rights contracts upon the establishment of building leases.
Although the law does not define categories of building leases, the author suggests different ways of establishing building leases and explains their nature and specific characteristics.
