Court practice in application of rules of the Dwelling Act

Summary


Matters concerning dwellings form a significant part of civil matters heard by courts. The author analyses the corresponding court practice including rulings made by county, city and circuit courts and the Supreme Court. Further, the authors briefly discusses the apartment scandal which broke out in Tallinn last year and in which a large number of apartments located in the old city were privatised as housing granted by employers. The author points out that the Dwelling Act provides for specific conditions under which apartments can be deemed to be housing granted by employers and, unlike other authors who have addressed this issue, is of the opinion that the interpretation of the corresponding rules of the Dwelling Act does not depend on whether disputes are in civil law or administrative law.
