Summary

Prof. Dr. Rolf Stober, Director of the Institute of Economic Law of the University of Hamburg, conducted a legal analysis of the Bill for the Estonian Economic Activity Act. The author analyses the compliance of the Bill with international conventions and EC law, the association agreement concluded between Estonia and the EU, and the Estonian Constitution. The main focus of the analysis is on the status of aliens and its conformity with international agreements. Further, the author evaluates the effectiveness of the Bill.
In general, the author’s evaluation of the Bill is positive. He also makes several suggestions how to improve the Bill. However, the author considers his suggestions mere formalities which do not impede passage of the Bill as law.
