Summary


Piracy in phonogram industry involves the following unlawful activities: the copying of original phonograms for commercial purposes without the authorisation of the holder of copyright or related rights; the production of copies which resemble the originals as much as possible without the authorisation of the holder of the corresponding rights; and bootlegging, i.e. the illegal recording of a performance of a singer or band. The author of this article analyses the benefit received from such piracy and the damage caused by piracy to authors, performers and producers of phonograms.
