Summary


Under subsection 82 (1) of the Copyright Act, a dispute concerning an infringement of copyright and related rights may on the basis of the application of one party or both parties be resolved by the Copyright Committee of the Ministry of Culture by way of conciliation of the parties. Under the Copyright Act, this Committee has restricted functions. The Committee may resolve a dispute on the basis of the application of one party or both parties. A dispute is considered resolved if a compromise satisfying both parties has been reached. However, such compromise is not binding on the parties.
Under subsection 82 (1) of the Copyright Act, a dispute is resolved by a court if:
one party fails to perform the agreement reached in the course of conciliation;
no agreement is reached.
The Ministry of Culture is planning to initiate the amendment of the Copyright Act and reorganisation of the work of the Committee. The Committee should ideally operate as an arbitral tribunal.
